Enforcement Cases

If you are considering initiating an enforcement case or if you are a respondent in an already initiated enforcement case (with a private judicial enforcement officer or a state judicial enforcement officer) and you need protection, you can rely on us.

We prepare and assist in obtaining all necessary documents - from filing an application for the issuance of an enforcement order and obtaining it, through initiating an enforcement case, to procedural representation and taking actions for forced satisfaction and collection of due amounts.

To fully protect your rights and legitimate interests, we prepare all necessary documents and provide procedural representation in the following:

  • Filing a declaratory claim for the non-due amounts for which an enforcement order has been issued;
  • Protection of the rights and legitimate interests of the debtor in the enforcement proceedings;
  • Protection against illegal actions of the judicial enforcement officer;
  • Legal protection and assistance in cases where enforcement is directed at assets representing marital community property;

We provide procedural representation in expedited proceedings - obtaining an execution order under Article 410 of the Civil Procedure Code (CPC) or an order for immediate enforcement under Article 417 of the CPC, representation in proceedings for obtaining an enforcement order, initiation of enforcement cases, and procedural representation as well as protection of the debtor in the same proceedings.

  • Representation in precautionary proceedings - we prepare all necessary documents and represent the party in proceedings for securing a future claim or an already filed claim, including obtaining a precautionary order for imposing a ban on immovable property and its registration, as well as imposing a seizure on movable assets, the debtor's receivables, shares in companies, stocks, bank accounts, and other precautionary measures;
  • Preparation of a complete set of documents for participation in a public auction for the purchase of property - bidding offer, application, and others, depending on the specific case;
